16. Governing Law and Jurisdiction

This terms of use will be governed by the laws of the United Arab Emirates as applicable in Dubai. Any dispute arising out of or related to these terms of use shall be finally resolved by binding arbitration as set out below, under the Arbitration Rules of the Dubai International Finance Centre – London Court of International Arbitration ("LCIA"). The number of arbitrators shall be one. The parties shall have 30 days from receipt of notice of the arbitration in which to agree on the appointment of the sole arbitrator and if no agreement is reached, the LCIA Court shall appoint the arbitrator. The seat or legal place of arbitration shall be Dubai International Arbitration Centre in Dubai, UAE. The language to be used in the arbitral proceedings and in the award shall be in English. Notwithstanding the foregoing, TradeTracker retains the right to seek interim relief at any time from any court of competent jurisdiction, and nothing in this arbitration clause shall be deemed to prevent or restrict TradeTracker from doing so.

17. General

In the event any one or more of the provisions of these terms of use shall for any reason be held to be invalid or unenforceable by any court having competent jurisdiction, the remaining provisions of these terms of use shall be unimpaired. The failure of either party at any time to require the performance by the other party of any provision of this Agreement shall not affect in any way the right to require such performance at any later time. No waiver of any of these terms of use shall be held to be a further or continuing waiver of such term or condition or any other term or condition.
